Emerald Isle vacation rental rules

Emerald Isle sizes trash service to the number of bedrooms in a vacation rental. Each residential vacation rental unit needs at least one 90/95-gallon rollout garbage container for every three bedrooms. The count rounds up, so four bedrooms need two containers and eight need three. Recycling follows the same ratio, with marked 90/95-gallon carts. Any room with a place to sleep counts as a bedroom, including a sleeper sofa, a cot or a crib. Noon on the day before pickup is the earliest a cart may reach the street. By 9:00 a.m. on the day after, it must be stored again.[6]

What Emerald Isle asks of you

  • No rental permit or registration appears in the code, as codified through an ordinance of September 9, 2025.[5]

  • Each shortfall carries a $100 civil penalty, for garbage and recycling alike. The town manager can drop it once the right carts are in service.[6]

  • Carts left at the street outside the allowed hours draw a $50 penalty.[6]

  • The town's FAQ puts the first roll-out on the resident, the owner or the vacation rental company.[7]

  • That FAQ asks each vacation rental for one standard 96-gallon garbage container per three bedrooms. For recycling it names a 90-gallon cart.[7]

  • The code itself specifies 90/95-gallon carts for both garbage and recycling.[6]

  • A lot may carry one sign reading VACATION RENTAL or VACATION LEASE. A duplex may carry two. On residential land each face stays within four square feet.[8]

  • That sign goes on the building it advertises, never on the beach side of an oceanfront lot.[8]

  • Off-street parking rises with gross floor area, from two spaces below 1,500 square feet to eight at 6,500 or more.[8]

  • From 8:00 p.m., unattended tents, chairs or umbrellas cannot stay on the beach. Beachgoers can set them up again from 8:00 a.m. onward. Anything left overnight counts as abandoned property, which the town removes.[9]

  • Oceanfront owners are excepted from the overnight rule after a written request with proof of ownership.[9]

  • The town's beach equipment FAQ limits that exception to two stickers per oceanfront owner. Guests cannot get one.[10]

What North Carolina asks wherever you host

  • Under G.S. 160D-1207(c), no North Carolina city can make registration a condition of renting your property. Demanding a housing-code permit before you rent is barred as well. The Court of Appeals applied that rule in Schroeder v. City of Wilmington.[1]

  • Zoning is what remains. In that case the court let a city keep whole-house lodging inside named districts. Parking rules survived too, as did limits on large events. So did insurance conditions and posted safety information.[1]

  • Renting out a private residence or cottage owes North Carolina's 4.75% sales tax. Local and transit rates come on top. So does any occupancy tax levied by the city or county. Sales tax stops once a single guest has stayed ninety days in a row.[3]
