South Lake Tahoe short-term rental laws (2026)

South Lake Tahoe treats its residential zones and its tourist areas very differently, and renting a whole home short term is legal in either only with a city Vacation Home Rental permit. In the Tourist Core and other commercial or recreation areas, the permit follows the lighter plan-area rules. In residential zones, permits are capped at 900, and every rental needs a property manager who answers 24/7 and reaches the home within 60 minutes. A permit goes to the owner of record, with no primary-residence rule, and lasts one year. Applying costs $548 plus a $285 inspection, and violation fines run $1,500 to $5,000.[1]

How to apply in South Lake Tahoe

Official name: Vacation Home Rental (VHR) permit

    Check on the city's plan area map whether your parcel is in a residential zone, where new applications go to the waitlist.[1]

    Apply online through the city's permit portal and pay the $548 application fee.[1]

    List the owners, property manager, 24/7 local contact, bedrooms, paved parking spaces and any outdoor hot tub on the application.[2]

    The city aims to inspect within 14 days of a complete application, and you have 45 days to make required changes.[2]

Are short-term rentals allowed in South Lake Tahoe?

Why was South Lake Tahoe's Measure T overturned?

Measure T, approved in 2018, banned vacation rentals in residential areas. On March 13, 2025, the El Dorado County Superior Court found its Qualified VHR provisions unconstitutional and not severable, which struck down the whole measure.[2]

How many guests can stay at a vacation rental in a residential area?

The lower of four people per paved parking space or two per bedroom, two for a studio. Up to five children aged 13 and under do not count in homes with bedrooms.[2]

Can I rent out a room while I live in my South Lake Tahoe home?

Yes, with a Hosted Rental permit, if the home is your principal residence or you hold a lease of two years or more. You stay overnight during stays, with two guests per hosted bedroom and six in total.[3]
