Maui County short-term rental laws (2026)

Maui County prohibits transient vacation rentals in every zoning district, then carves out exceptions. Hotels are one. A house qualifies only with one of the county's two home permits. The same code governs Maui, Molokai and Lanai.[1]

Maui short-term rental rules

Maui County bans rentals of less than 180 days by default. The exceptions are hotel districts and homes holding a county permit. In a house, you need a short-term rental home permit, and each community plan area has a cap. West Maui allows 50 permits, Kihei-Makena 46 and Molokai none. You must have owned the home for at least fifteen years, and you may hold only one permit. Apartment-district vacation rentals are being phased out. They must stop on January 1, 2029 in West Maui and on January 1, 2031 elsewhere. Operating without a required permit can cost $20,000 at most for the first fine, with a daily fine capped at $10,000.[2]

  • Allow a compliance inspection within one hour of notice[2]
  • Hold state TAT and GET licenses for the home[2]
  • Pay the 3% county TAT to Maui County[7][13]

  • Rent for under 180 days outside a hotel district without a county permit[1]
  • Rent an accessory dwelling as a short-term rental home[2]
  • Hold more than one short-term rental home permit[2]
  • Offer more than six bedrooms on Maui, or three on Lanai and Molokai[2]
  • Host more guests than twice the approved bedrooms[2]
  • Allow parties, group gatherings or street parking[2]
  • Use amplified sound audible beyond the property line[2]
  • Advertise before the permit is approved[2]
  • Apply for a short-term rental home permit on Molokai, where the cap is zero[2]

Not required

  • Living in a short-term rental home yourself[2]
  • A yearly night cap[2]
  • A separate county tax return: you file with the state[13]
  • Proof of insurance in the permit application[2]

How to apply in Maui County

Official name: Short-term rental home permit

    Get a Land Use Designation Form processed for the property. It must be attached to the application.[11]

    Have the house inspected by a home inspector certified by the American Society of Home Inspectors.[2]

    Submit the application online through MAPPS, the county's permitting system.[11]

    Notify owners and lessees within 500 feet by certified mail. Post a four-square-foot notice sign at the front of the property.[2]

    Wait for the decision. The county says processing may take several months, and neighbor protests can send the application to the planning commission.[11]

Maui County short-term rental questions

Can I do Airbnb in Maui?

Only in a hotel district, or with a county permit. Maui County prohibits rentals of less than 180 days everywhere else. A house needs a short-term rental home permit. A bed and breakfast home permit is the other route.[1]

Is Maui banning short-term rentals?

Not all of them. Ordinance 5909 phases out vacation rentals in apartment districts. They must cease on January 1, 2029 in West Maui and on January 1, 2031 in the rest of the county. Time share units are exempt.[9]

How many short-term rental home permits does Maui allow?

The code sets a cap for each community plan area. West Maui has 50, Paia-Haiku 48 and Kihei-Makena 46. Hana, Lanai and Makawao-Pukalani-Kula have 15 each. Wailuku-Kahului has 6.[2]

Are short-term rentals allowed on Molokai and Lanai?

Molokai's cap on short-term rental home permits is zero. Lanai allows 15, with three bedrooms at most and a manager who lives on the island full time.[2]

How much does a Maui short-term rental home permit cost?

The county's permit page gives no amount. It says fees are set in the annual budget ordinance and that the applicant is notified when payment is due.[11]
