1. Scope

WonderGuest is operated by SEEDFLOW, a French simplified joint-stock company (SAS) with its registered office at 24 rue Lombard, 33300 Bordeaux, France (“SEEDFLOW”). Hosts publish content in their digital guidebooks: texts, photos, videos, documents and extras listings. That content is stored and displayed by WonderGuest at the direction of the host who publishes it.

SEEDFLOW respects the intellectual property rights of others and responds to notices of claimed copyright infringement that comply with the United States Digital Millennium Copyright Act (17 U.S.C. § 512). Notices under French law (article 6 of the Loi pour la confiance dans l’économie numérique) and under the EU Digital Services Act are accepted at the same address, with the same information.

2. Reporting copyright infringement

If you believe that content published in a WonderGuest guidebook infringes a copyright you own or are authorized to enforce, send a written notice to our designated agent (section 3). To be effective under 17 U.S.C. § 512(c)(3), the notice must include:

  • your physical or electronic signature, or that of a person authorized to act on behalf of the copyright owner;
  • identification of the copyrighted work you claim has been infringed or, if several works are covered by one notice, a representative list of those works;
  • identification of the material you claim is infringing and enough information for us to locate it, such as the full URL of the guidebook page;
  • your name, postal address, telephone number and email address;
  • a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law;
  • a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

An incomplete notice may delay or prevent action. We may share your notice, including your contact details, with the host who published the material.

3. Designated agent

4. What happens after a valid notice

When we receive a notice that meets the requirements above, we promptly remove or disable access to the material identified, inform the host who published it and provide the host with a copy of the notice. The host may then send a counter-notice.

5. Counter-notice

If material you published was removed or disabled and you believe this was the result of a mistake or misidentification, you may send a counter-notice to the designated agent. Under 17 U.S.C. § 512(g)(3), it must include:

  • your physical or electronic signature;
  • identification of the material that was removed or disabled and the location at which it appeared before removal;
  • a statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • your name, postal address and telephone number;
  • a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located or, if your address is outside the United States, of any judicial district in which SEEDFLOW may be found, and that you will accept service of process from the person who sent the original notice or that person’s agent.

We forward valid counter-notices to the person who sent the original notice. Unless that person informs us within 10 business days that they have filed a court action to restrain the host from engaging in the infringing activity, we may restore the material no sooner than 10 and no later than 14 business days after receiving the counter-notice.

6. Repeat infringers

SEEDFLOW terminates, in appropriate circumstances, the accounts of hosts who are repeat infringers, as provided in section 6 of the Terms of Use. We may also remove content or suspend an account after a single notice when the circumstances warrant it.

7. False notices

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by the copyright owner or by SEEDFLOW. If you are unsure whether a use is infringing, consider seeking legal advice before sending a notice.

8. Other complaints

For trademark, privacy, defamation or other complaints about guidebook content, write to support@wonderguest.app with a description of the content, its URL and the reason for your complaint.
