North Topsail Beach vacation rental rules
North Topsail Beach has no short-term rental permit. The use table of its Unified Development Ordinance has no line for short-term or seasonal rentals. What it does regulate is house size. A home stays a by-right use in seven districts while it has eight bedrooms at most. A house below 5,000 heated square feet keeps that status too, whatever its bedroom count. Past both thresholds, a single-family home needs a special use permit. Its parking plan must show one space per bedroom up to ten. Every bedroom beyond ten needs two. Height on those large houses is capped at 48 feet.[5]
What North Topsail Beach asks of you
The ordinance sends short-term rental to its definition of seasonal rental, borrowed from the North Carolina Vacation Rental Act at G.S. 42A-4.[5]
A home with fewer than three rooms needs two off-street spaces, plus one per additional room. The count skips the kitchen and the bath. Dining and living rooms are skipped too.[5]
A bed and breakfast is allowed by right in the same seven districts as a single-family home. It adds one parking space per guest room to the residential count.[5]
Owners of rental property must sign up for the town's solid waste program. A private hauler under contract is the alternative.[6]
From noon on the eve of pickup, carts may stand in the street right-of-way. The deadline to clear them is 10:00 a.m. on the following day.[6]
Each rolling cart carries the owner's street address. A first violation brings a written warning, and later ones are fined per occurrence.[6]
The town's code is current through an ordinance passed June 5, 2024. Its development ordinance runs through January 8, 2025.[7]

Under G.S. 160D-1207(c), no North Carolina city can make registration a condition of renting your property. Demanding a housing-code permit before you rent is barred as well. The Court of Appeals applied that rule in Schroeder v. City of Wilmington.[1]
Zoning is what remains. In that case the court let a city keep whole-house lodging inside named districts. Parking rules survived too, as did limits on large events. So did insurance conditions and posted safety information.[1]
Renting out a private residence or cottage owes North Carolina's 4.75% sales tax. Local and transit rates come on top. So does any occupancy tax levied by the city or county. Sales tax stops once a single guest has stayed ninety days in a row.[3]
