Holden Beach vacation rental rules

Holden Beach allows vacation rentals in its R-1 residential district, provided each booking includes at least two overnight stays. The code calls a dwelling a residence where people live for domestic purposes. It then says nothing prevents one- and two-family homes from being used as vacation rental homes on those terms. Transient occupancy shorter than two nights is treated as inconsistent with domestic residential use, and the code does not allow it. Persistent use of a house for group gatherings held for social or recreational purposes falls under the same ban.[4]

What Holden Beach asks of you

  • In the R-1 district, one- and two-family homes may operate as vacation rental homes when each booking covers at least two overnight stays.[4]

  • Transient occupancy of fewer than two nights is not allowed, nor is persistent use of a home for group gatherings.[4]

  • Each bedroom needs a private parking space of 10 by 20 feet, kept clear for the life of the structure. The town added that definition on May 20, 2025.[5]

  • The parking table asks for two spaces per dwelling unit or one per bedroom, whichever is greater.[6]

  • A rental home must keep one trash cart for every two bedrooms. Since April 21, 2021, a recycling cart no longer counts toward that number.[7]

  • From 10:00 p.m., the sound limit in residential districts drops to 50 dB(A). The daytime limit of 60 dB(A) returns at 7:00 a.m.[8]

  • A noise violation carries a $300 civil penalty. Each repeat within twelve months costs $500.[9]

  • An absentee owner is liable for a guest's second violation within twelve months. The earlier violation must first have been notified by registered or certified mail.[9]

  • Under G.S. 160D-1207(c), no North Carolina city can make registration a condition of renting your property. Demanding a housing-code permit before you rent is barred as well. The Court of Appeals applied that rule in Schroeder v. City of Wilmington.[1]

  • Zoning is what remains. In that case the court let a city keep whole-house lodging inside named districts. Parking rules survived too, as did limits on large events. So did insurance conditions and posted safety information.[1]

  • Renting out a private residence or cottage owes North Carolina's 4.75% sales tax. Local and transit rates come on top. So does any occupancy tax levied by the city or county. Sales tax stops once a single guest has stayed ninety days in a row.[3]
