The Town of Webb treats any rental shorter than six months as short term. Its permit rule kicks in once a home is rented more than 14 cumulative days in a calendar year. A unit used that way needs its own permit.[4]

Town of Webb short-term rental permit

A Town of Webb short-term rental permit comes from the Code Enforcement Officer, who inspects the unit before issuing or renewing it. Each permit runs 24 months from its date of issue. The town's 2022 law set the fee at $800 for one to three bedrooms. For four bedrooms or more, the same law set $1,600. The Town Board may adjust those amounts by resolution.[4]

What Webb asks of you

  • The Town Board adopted Chapter 387, the Short-Term Residential Rentals Law, on September 13, 2022.[4]

  • The application lists the tax map parcel number and the size of each bedroom. It includes a plan of the emergency egress windows.[4]

  • The owner names a property representative who answers complaints within 24 hours at the latest.[4]

  • The permit, the inspection report and the occupant limit stay posted inside the home. So do the representative's name and phone number.[4]

  • Fire and property maintenance codes set the occupant limit. The capacity of the septic system can lower it.[4]

  • Unless septic records are already on file with the town, the tank is pumped and inspected before the first permit.[4]

  • The owner shows there is enough lawful parking for the number of occupants allowed.[4]

  • Advertising a rental that has no valid permit is treated as a violation, as if guests were already there.[4]

  • A home rented to one family for under 14 cumulative days a year is exempt. Renting rooms to separate parties ends that exemption.[4]

  • Cottage colonies and other properties regulated by the state Department of Health fall outside the chapter.[4]

  • In the town's residential village zoning districts, permits may not exceed 10% of the real property parcels.[5]

  • Once that share is reached, the zoning and codes office keeps a waitlist. Openings go first to the owners who have waited longest.[5]

  • Permits held when the cap took effect continue if renewed on time. Selling the property while permits exceed 10% ends the permit.[5]

  • Accessory dwelling units cannot receive a short-term rental permit, under a local law filed on March 16, 2026.[6]

  • A first violation draws a fine of up to $350. A second within 12 months ranges from $350 to $700.[4]

  • Third and later violations are fined $700 to $1,000. Every full week of continued violation is a new one.[4]

  • From the third violation on, the Code Enforcement Officer may suspend the permit. A civil penalty can also reach $200 per day.[4]

  • In New York State, the county keeps the short-term rental registry. Once yours opens, the unit is registered there and its number appears on each listing.[1]

  • Short-term stays have carried sales tax since March 1, 2025. When a platform takes the booking, the platform charges that tax and remits it.[2]

  • Local control stays with cities, towns and villages, which can set operating rules. A local law can also ban short-term rentals outright.[1]
