Ocean Isle Beach short-term rental rules
Ocean Isle Beach permits short-term rentals through its zoning code, which names short-term occupancy as a use in its residential districts. In R-1, the island's single-family district, a home may be occupied short term or long term. Two-family dwellings stopped being a permitted use there on February 9, 1999. The mainland R-1M district allows single- and two-family dwellings on the same terms. In C-1, the commercial accommodations district, hotels and motels join the residential uses. One R-1 rule targets rentals directly: lockout rooms for multi-tenant occupancy are prohibited.[4]
What Ocean Isle Beach asks of you
The R-1 single-family district permits single-family homes for short-term or long-term occupancy.[4]
Two-family dwellings have not been a permitted use in R-1 since February 9, 1999.[4]
R-1 prohibits lockout rooms used for multi-tenant or multifamily occupancy.[4]
Short-term rental owners must supply waste and recycling carts according to bedroom count. A home with one to four bedrooms needs one of each.[5]
Ten bedrooms or more call for four waste carts. Two recycling carts complete the set.[5]
A sleeper sofa or a cot turns its room into a bedroom for that count.[5]
Carts may go out within seven feet of the paved road from 6:00 p.m. the evening before pickup. They have to come back in by 7:00 p.m. on collection day.[5]
On the island, a house of up to 2,500 square feet needs five parking spaces. One of 3,001 to 3,500 square feet needs eight.[6]
A rental house may display one sign advertising the rental, no larger than two feet by three feet.[7]
What North Carolina asks wherever you host

Under G.S. 160D-1207(c), no North Carolina city can make registration a condition of renting your property. Demanding a housing-code permit before you rent is barred as well. The Court of Appeals applied that rule in Schroeder v. City of Wilmington.[1]
Zoning is what remains. In that case the court let a city keep whole-house lodging inside named districts. Parking rules survived too, as did limits on large events. So did insurance conditions and posted safety information.[1]
Renting out a private residence or cottage owes North Carolina's 4.75% sales tax. Local and transit rates come on top. So does any occupancy tax levied by the city or county. Sales tax stops once a single guest has stayed ninety days in a row.[3]
