Where short-term rentals are allowed in Longboat Key, FL

Longboat Key is the clearest example in Florida of why a date matters more than a policy. Its Ordinance 82-10 has limited the duration and frequency of short-term rentals in residentially zoned property since 1982, which puts it almost three decades ahead of the June 2011 cut-off that freezes state preemption. Unless your property is in a tourism-zoned district or grandfathered as a tourism use, the minimum rental period is thirty consecutive days, one whole calendar month or longer. Check the zoning district before anything else.[6]

Longboat Key rental restrictions

Longboat Key restricts short stays through zoning and a minimum rental period rather than a permit fee. Unless the property is grandfathered as a tourism use or sits in a tourism-zoned district, each individual rental period must be at least thirty consecutive calendar days, one entire calendar month, or longer. Tourism-zoned districts and grandfathered tourism properties are outside that minimum. Separately, any rental of less than six months requires the property or unit to register with the town for a Residential Rental Certificate of Registration. The restriction rests on Ordinance 82-10, in place since 1982, which is what puts it clear of the Florida preemption on rental duration and frequency: that preemption only reaches local rules adopted after June 1, 2011. Look up the parcel's zoning district before anything else.[6]

What Florida asks wherever you host

These rules apply at this address whatever the city decides.

  • Florida licenses vacation rentals itself. A house, townhouse or unit in a building of four units or fewer is licensed as a dwelling, a unit in a condominium or cooperative as a condominium, and the licence costs $150 plus $10 per rental unit plus a $10 hospitality education fee.[2]

  • A city cannot ban vacation rentals, nor regulate how long or how often you rent, unless its ordinance was already on the books on June 1, 2011. Ordinances adopted before that date survive untouched, which is why two neighbouring Florida towns can sit at opposite ends of the scale.[1]

  • State sales tax is due on every rental of six months or less. A bona fide written lease for more than six months of continuous residence is exempt, and so is the seventh month onward once a guest has stayed and paid for six.[3]

FAQ

Longboat Key short-term rental questions

Can I rent a Longboat Key house by the week?

Only in a tourism-zoned district, or if the property is grandfathered as a tourism use. Elsewhere the minimum is thirty consecutive days or a full calendar month.[6]

Why can Longboat Key set a minimum stay when Florida preempts that?

Because the preemption only reaches local rules adopted after June 1, 2011, and Ordinance 82-10 dates from 1982.[6]

Do I still have to register a thirty-day rental?

Yes if it runs under six months: the town requires a Residential Rental Certificate of Registration for any rental below that threshold.[7]
