Estero only became a village in 2014, when the Legislature passed its charter as chapter 2014-249. Its Code of Ordinances, codified through December 17, 2025, has no article on renting homes to guests.[6]

Estero short-term rental rules

Estero has no short-term rental rules. Its Land Development Code, codified through Ordinance 2025-04 of July 2, 2025, has no vacation rental section. The code keeps the term hotel or motel for buildings with at least ten sleeping rooms under single control. A bed and breakfast is a separate use with its own standards. The owner or a family member lives there as a primary resident. A guest's stay is capped at two weeks per visit.[7]

What Estero asks of you

  • The village's business chapter covers sexually oriented businesses and gas pump security. Nothing in the Code of Ordinances regulates vacation rentals.[6]

  • Bed and breakfasts may offer ten guest rooms at most, plus one extra parking space for each room.[7]

  • Florida preempts any local limit on rental duration or frequency that was not already adopted by June 1, 2011.[1]

  • Lee County's code makes the property owner ultimately responsible for the tourist tax, whatever agreement exists with an agent.[8]

What Florida asks wherever you host

  • Florida licenses vacation rentals itself. A dwelling license covers houses, townhouses and buildings of up to four units. A condominium or cooperative unit takes a condominium license instead. The license costs $150 plus $10 per rental unit, plus a $10 hospitality education fee.[2]

  • No Florida city may ban vacation rentals. It may not set how long or how often you rent either. The one exception is a local ordinance already in force on June 1, 2011, which still applies.[1]

  • State sales tax is due on every rental of six months or less. A bona fide written lease for more than six months of continuous residence is exempt. So is the seventh month onward once a guest has stayed and paid for six.[3]

Estero short-term rental questions

Do Lee County ordinances apply inside Estero?

Those in force when the village incorporated stay in place until the council rescinds them, under section 12 of the charter. Where a village ordinance conflicts with one, the village rule prevails.[6]

Can the county check a rental inside a gated community?

Yes. Lee County's tourist tax audits may examine records held by homeowners and condominium associations. The code cites guest gate entry passes as well as golf and tennis membership records.[8]

I only rent in season. Do I still file a tourist tax return?

Yes, though only once a year. The Clerk lets seasonal renters submit a single annual return, and its application form lays out the filing options.[9]
