Where short-term rentals are allowed in Venice, FL

In Venice, the zoning code does not count a house let for a week or less as residential use. The land development code adopted in 2022 classes that stay as transient lodging, which it files under commercial uses.[9]

Venice FL short-term rental rules

Venice allows no new resort dwellings in its RE and RSF zoning districts, the single-family neighborhoods the rule is meant to protect. A rental of at least 30 days, or of one full calendar month, is not a resort dwelling. Existing ones may continue, under conditions. Each must post an all-weather placard of 11 by 17 inches beside the front entrance. It names a contact reachable 24 hours a day and the maximum occupancy. Every car parks off the street, with at least one paved space per bedroom. A log of each tenant's name, address and vehicle must be kept for city inspection.[6]

What Venice asks of you

  • A one- to four-family unit in those districts turns into a resort dwelling with its fourth rental of under 30 days in one calendar year. Holding the unit out as regularly rented for such stays has the same effect.[7]

  • Section 6.4 keeps the content of the city's previous code. Its stated aim is compliance with section 509.032(7)(b) of Florida Statutes.[6]

  • Where an RE or RSF lot holds more than one legal dwelling, the resort dwelling ban covers every structure on it.[6]

  • Using a single-family home as a resort dwelling counts as a change of use. Operating ones must request a change of use and a revised occupancy permit.[6]

  • Trash may sit outside only from 6:00 p.m. the day before pickup. It comes back in by 6:00 p.m. on pickup day.[6]

  • For apartments and condominiums, the code expects tenancy of more than one week. A shorter tenancy is not considered residential.[9]

  • Venice charges $20 a unit for the business tax receipt on residential rentals, be it a condominium, a duplex or a house. It applies to units an owner or unlicensed agent rents for up to six months.[10]

What Florida asks wherever you host

These rules apply at this address whatever the city decides.

  • Florida licenses vacation rentals itself. A dwelling license covers houses, townhouses and buildings of up to four units. A condominium or cooperative unit takes a condominium license instead. The license costs $150 plus $10 per rental unit, plus a $10 hospitality education fee.[2]

  • No Florida city may ban vacation rentals. It may not set how long or how often you rent either. The one exception is a local ordinance already in force on June 1, 2011, which still applies.[1]

  • State sales tax is due on every rental of six months or less. A bona fide written lease for more than six months of continuous residence is exempt. So is the seventh month onward once a guest has stayed and paid for six.[3]

Venice short-term rental questions

When was the Venice resort dwelling rule adopted?

Its source is Ordinance 2009-06, adopted July 14, 2009, under what was then section 86-151 of the city code.[8]

What must the Venice placard show?

A contact who answers 24 hours a day, plus the maximum occupancy under Chapter 69A-43 of the Florida Administrative Code. It also gives the vehicle limit and the trash pickup day.[6]

Does the county send owners back to the city?

Yes. Sarasota County's Tax Collector tells owners to check zoning with Venice before offering a unit for six months or less. A rental inside city limits also pays business tax to the city.[11]
