In Kill Devil Hills, where a short-term rental can operate depends on the kind of dwelling as much as on the zone. The Low Density Residential zone permits single-family and duplex dwellings. Accessory dwelling units are allowed there for long-term occupancy only. Cluster homes in that zone must also be occupied long term. Their owners sign a long-term use agreement before any building permit. The agreement is recorded with the Register of Deeds and transfers with the property in perpetuity.[6]

  • Any rental cottage needs a town-approved container sized to its waste. One to four bedrooms need one roll-out container, except a four-bedroom home east of US 158, which needs two.[7]

  • Five or six bedrooms call for three roll-out containers. From seven to 18 bedrooms a dumpster is required, with two dumpsters above 18.[7]

  • The town lists Ordinances 20-7, 20-18 and 20-19 as adopted. None of them is in the online code yet. Their titles cover civil penalties, the parking table and large single-family dwellings.[8]
