Kiawah Island short-term rental license

An owner who rents short term on Kiawah Island needs an annual Class 7 rental business license for each property before advertising it. In the R-1 district and listed R-2 areas, licenses are capped at 20% of developed lots. The yearly application fee there is $500, against $200 for other properties. Once the cap is reached, new applicants join a waiting list. Licenses expire on April 30 and do not pass to a new owner, except within a family. Every advertisement shows the license number and the approved bedrooms. It must also give the maximum occupancy and the overnight vehicle limit.[5]

What Kiawah Island asks of you

  • A short-term rental means an accommodation rented out for stays under 30 consecutive days, in a property assessed as residential for county tax.[5]

  • The 20% cap covers the R-1 district plus named R-2 areas, Indigo Park and Ocean Oaks among them. Other R-2 areas and R-3 have no limit.[5]

  • Licenses in good standing renew first, by April 30. A late renewal costs a $1,000 late fee on top of other fees.[5]

  • In a capped area, the owner of a vacant lot can hold a provisional lot license for three years. It secures a rental license once a certificate of occupancy issues.[5]

  • A license may not be renewed when the owner reports under $3,000 of annual rental revenue. The exception is a home that was available and advertised all year.[5]

  • First-time licenses need a rental inspection. So does any change in bedrooms or parking capacity.[5]

  • Maximum occupancy is two people per code-compliant bedroom plus two per unit. Children under two do not count.[5]

  • Vehicles park only on paved or gravel surfaces, up to the number of spaces on the application. Large pickups, RVs and trailers cannot stay overnight.[5]

  • The whole property must be rented. Single rooms cannot be rented on their own. Neither can a guest house or a pool house.[5]

  • Owners living outside the Charleston metro area name a local contact who can respond within two hours of an emergency.[5]

  • Rental homes subscribe to back-door trash collection twice a week, with bins kept out of sight from the street.[5]

  • At renewal, the owner shows proof of the previous year's accommodation tax payments.[5]

  • Violations carry fines up to $500, up to 30 days in jail, or both, with each day a separate offense.[5]

  • Three violations in a rolling 12 months are cause for revocation. The owner may reapply no sooner than 12 months later.[5]

  • The state's Vacation Rental Act requires each stay under 90 days to come with a written agreement. Guests must leave when authorities order a mandatory evacuation.[3]
