Breezy Point short-term rental license

A Breezy Point owner needs Crow Wing County's license first, then the city's, before taking a booking. The city application includes a copy of the approved county license and the parcel number. It also needs a sketch plan showing bedrooms and off-street parking. City licenses run from January 1 to December 31. A renewal must be approved before any rental activity in the new year. A license not renewed by January 1 is considered expired. Ordinance 2022-02 caps the city at 60 licenses at any given time.[4]

What Breezy Point asks of you

  • A Crow Wing County short-term rental license must be obtained before the city issues its own, and a copy goes with the city application.[4]

  • The city issues no more than 60 short-term rental unit licenses at any given time, first come, first served.[5]

  • The licensing period runs January 1 to December 31. Renewals for the next year must be approved before any rental activity.[4]

  • Occupancy follows the bedroom count. A bedroom needs at least 70 square feet for one occupant, 90 for two, then 50 more for each extra occupant.[5]

  • Recreational vehicles and tents cannot be used to add occupancy. Neither can accessory structures or fish houses.[5]

  • A listing may not advertise more bedrooms, or more guests, than the license allows.[5]

  • The owner or an authorized agent must be reachable 24 hours a day, 7 days a week, during every rental. Each renter receives that contact in writing.[5]

  • A new owner cannot take over the license.[5]

  • Four substantiated complaints or violations within 18 months may lead the City Council to revoke the license. After a revocation, two within 18 months can end eligibility for good.[5]

  • Crow Wing County charges $100 per advertised bedroom for its license, renewed every January whatever the issue date.[6]

What Minnesota asks wherever you host

These rules apply at this address whatever the city decides.

  • On top of whatever the city requires, the Minnesota Department of Health files a vacation home rental under the hotel or motel license. The address decides whether MDH or a local health agency issues it.[1]

  • Rent for a residential short-term rental is taxable lodging in Minnesota. Whoever facilitates the booking collects the tax: the owner, the platform, or each on its own share.[2]

  • Section 297A.66 makes an accommodations intermediary collect the sales tax on lodging located in Minnesota and remit it to the Department of Revenue.[3]
