Breckenridge short-term rental license

Breckenridge requires an accommodation unit license before a home is advertised for rent. A studio pays $75 a year for it, and the price climbs to $175 at four bedrooms. A regulatory fee of $756 per bedroom or studio is added, with no cap on bedrooms charged. The number can go in the listing's license field or in its details. A responsible agent stays reachable around the clock to answer complaints within 60 minutes.[4]

What Breckenridge asks of you

  • The code calls the title an accommodation unit license. Any lease under 30 consecutive days needs it, however rarely the unit is rented in a license year.[7]

  • The town's web page names the same title a short-term rental license. Each property needs its own, which cannot be transferred when the home is sold.[3]

  • The bedroom-based license fee climbs in $25 steps, from $75 for a studio. The $756 regulatory fee per bedroom comes on top, so a studio owes $831 a year.[4]

  • The regulatory fee is waived when the unit is the holder's primary residence, rented 21 days a year at most. The exemption is requested by email.[4]

  • The town counts four areas. A Resort Properties Zone sits beside a Tourism Zone (Zone 1), the downtown core (Zone 2) and residential areas (Zone 3).[6]

  • Zone 1 may hold no more than 1,680 licenses. The ceiling is 130 in Zone 2, then 390 in Zone 3.[7]

  • Zone 3 still counted 1,002 licenses against its 390 ceiling in July 2026.[5]

  • Licenses issued before September 27, 2022 sit outside the zone caps. They keep renewing until title passes to a new owner.[7]

  • When a license frees up in a full zone, the owner at the top of that zone's list gets 14 business days to apply. Selling the home voids its place on the list.[7]

  • Overnight occupancy stops at two persons per bedroom plus four. A studio sleeps four persons at most.[7]

  • Each advertisement prominently displays the license number with the maximum overnight occupancy. A written notice gives the owner 15 days to correct a faulty ad.[7]

  • Guest vehicles stay on the property or in a parking area the town designates. The public street beside the rental is off limits, as is sleeping in a car.[7]

  • The unit keeps a working smoke detector, a carbon monoxide detector and a fire extinguisher at all times.[7]

  • The town publishes no quiet hours in its short-term rental chapter. It bans unreasonable noise, weighing the time of day among other factors.[7]

  • The finance director may impose a fine of up to $1,000 per day until a violation is cured. Payment is due 14 days after the notice.[7]

  • Lodging taxes a city sets stay outside the state's system, since the Department of Revenue administers none of them. Home-rule cities that run their own sales tax sit outside it too, so start with your city.[1]

  • Hosts who take direct bookings need a Colorado sales tax license and collect the 2.9% state rate themselves. The license is $16, prorated, with a $50 deposit returned once your state tax tops $50.[2]
