Anaheim short-term rental permit

Anaheim no longer issues new short-term rental permits for homes in residential zones. Chapter 4.05 of the municipal code keeps a permit system for renewals of Pre-Moratorium Short-Term Rentals. Those are rentals the city authorized before August 11, 2016. The definition also covers a pending application filed before September 16, 2015, then approved after August 11, 2016. A permit runs until July 31, and the owner must renew it every year. The code leaves the fee to a City Council resolution. Each stay lasts at least three consecutive nights. Operating without a permit costs $500 for each day.[4]

What Anaheim asks of you

  • Chapter 4.05 says short-term rentals will no longer be allowable uses in any zone where residential uses are permitted.[4]

  • The code defines a short-term rental as a dwelling rented for less than thirty consecutive calendar days.[4]

  • The permit system serves renewals for Pre-Moratorium Short-Term Rentals, those the city authorized before August 11, 2016.[4]

  • Rentals in the C-G General Commercial Zone qualify when a conditional use permit predates the moratorium of September 15, 2015.[4]

  • Section 4.05.180 prohibits pre-moratorium rentals in residential zones after February 11, 2018. It exempts Qualifying Pre-Moratorium Short-Term Rentals and Pre-Moratorium Home Share Short-Term Rentals.[4]

  • CC&R Restricted Short-Term Rentals are prohibited in residential zones after December 31, 2022.[4]

  • A Pre-Moratorium Home Share Short-Term Rental is the owner's primary residence, a fact the owner demonstrates at each annual renewal.[4]

  • Each property needs a valid business license in addition to the short-term rental permit.[4]

  • A permit is valid until July 31 of the year issued. The renewal application is owed no later than the last business day of July.[4]

  • Once a permit lapses through expiration, failure to renew or revocation, the owner has no further right to obtain one.[4]

  • Fees are established by resolution of the City Council. Chapter 4.05 states no dollar amount.[4]

  • The permit does not run with the land. A buyer files a transfer application within fourteen calendar days of the change of ownership.[4]

  • Every rental lasts a minimum of three consecutive nights, a figure the owner must state in advertising.[4]

  • Advertising in any publication or website carries the city-issued permit number, which the code calls the REG ID#.[4]

  • Occupancy follows a table by bedroom count, with 4 occupants for one bedroom and 7 for two. The table tops out at nineteen persons.[4]

  • The property must have at least two off-street parking spaces. One city parking permit lets a single guest vehicle use the street.[4]

  • At 10:00 p.m. the code's quiet time begins. From 9:00 a.m. onward, outdoor activity is allowed again.[4]

  • A complaint starts a forty-five minute clock for the local contact, who has to respond in person.[4]

  • Whoever signs the rental agreement has to be twenty-one at least and occupy the unit during the stay.[4]

  • Weddings, receptions and parties are barred, along with other assemblies separate from lodging.[4]

  • An owner's first offense costs $200 when minor and $1,000 when major. The fifth offense within twelve months reaches $1,500 for a minor violation and $3,000 for a major one.[4]

  • Running a short-term rental without a permit draws a $500 fine for each day that a violation occurs.[4]

  • A hosting platform must remove an unpermitted listing within ten calendar days of the city's notice. Its own fines start at $500.[4]

  • No state license exists for short-term rentals in California. The state's 2025 act on booking platforms says it does not preempt a local short-term rental ordinance.[1]

  • Since July 1, 2024, every mandatory fee has to sit inside the rate you advertise. Only government taxes and fees may be added later.[2]

  • State law caps city fines when a short-term rental violation threatens health or safety. The first ceiling is $1,500. A second violation within the year reaches $3,000, each later one $5,000.[3]
